1. Agreement to Use Electronic Records and Signatures
By creating an account or completing a purchase on Luminessence, you consent to receive all communications, agreements, notices, and disclosures in electronic form ("Electronic Records") and to use electronic signatures in connection with your relationship with Luminessence.
2. Scope of Consent
Your consent applies to all communications relating to your Luminessence account, including:
- Account registration and verification notices
- Membership and subscription agreements
- Purchase receipts and billing statements
- Updates to our Terms of Use and Privacy Policy
- Marketing communications (where you have opted in)
- Any other notices or disclosures required by law
3. Hardware and Software Requirements
To access and retain Electronic Records, you will need:
- A device with internet access (computer, tablet, or smartphone)
- A current web browser (Chrome, Firefox, Safari, or Edge)
- The ability to receive email
- Sufficient storage to save or print Electronic Records for your records
4. Requesting Paper Copies
You may request a paper copy of any Electronic Record at no charge by contacting us at [email protected]. We will provide the paper copy within a reasonable time.
5. Withdrawing Consent
You may withdraw your consent to receive Electronic Records at any time by contacting us at [email protected]. However, withdrawing consent may limit or terminate your ability to use some or all of our services, and any Electronic Records already provided to you will remain valid.
6. Updating Your Contact Information
You are responsible for keeping your email address current in your account settings so that we can send you Electronic Records. You can update your contact information at any time in your account settings under Dashboard → Settings.
7. Legal Effect
Electronic Records and signatures have the same legal effect, validity, and enforceability as traditional paper documents and handwritten signatures in accordance with the Contract and Commercial Law Act 2017 (New Zealand) and other applicable laws.
8. Governing Law
This E-sign & Communication Authorization is governed by the laws of New Zealand.
